4.3 No Dentist-Patient Relationship

Use of this Site and its Services does not create a dentist-patient relationship, doctor-patient relationship, or any professional healthcare relationship. OwnThePractice does not practice dentistry, medicine, or any licensed healthcare profession through this Site.

4.4 California Dental Practice Act Compliance

In accordance with the California Dental Practice Act (California Business and Professions Code Sections 1625-1680), OwnThePractice does not engage in the practice of dentistry. Our services are limited to business education and consulting. 5. User Accounts

5.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update such information as necessary.

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice.

6. Membership and Payments

6.1 Membership Tiers

We offer multiple membership tiers with varying levels of access and pricing. Current tiers, features, and pricing are displayed on our Site and may be updated from time to time.

6.2 Billing and Renewals

Paid memberships are billed on a recurring basis (monthly or annually) as selected at the time of purchase. Your membership will automatically renew at the end of each billing period unless you cancel before the renewal date.

6.3 Cancellation and Refunds

You may cancel your membership at any time. Upon cancellation, you will retain access through the end of your current billing period. Refunds are handled in accordance with applicable California consumer protection laws. For annual memberships, you may request a pro-rated refund within 30 days of purchase. Monthly memberships are non-refundable for the current billing period.

6.4 Price Changes

We reserve the right to change membership prices. We will provide at least 30 days' notice before any price increase takes effect for existing members.

7. Intellectual Property

7.1 Our Content

All content on the Site, including text, graphics, logos, images, videos, templates, courses, and software, is the property of OwnThePractice or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our content for personal, non-commercial purposes related to your dental practice business education. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit our content without prior written permission.

7.3 Templates and Resources

Templates, checklists, and financial models provided through our Services are for informational purposes and personal use only. They are not a substitute for professional legal, financial, or accounting advice. You use them at your own risk.

7.4 User Content

By posting content in our community forums or other interactive features, you grant OwnThePractice a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content in connection with our Services. You retain ownership of your content.

8. Community Guidelines

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless OwnThePractice and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you post or submit through the Services.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the State of California. You agree to waive any right to a jury trial or to participate in a class action.

14.3 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court in California for disputes within the court's jurisdiction.

14.4 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Site and updating the "Last Updated" date. For significant changes, we will notify you via email. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
